Alas, this is not a good-news story, but hopefully the game is not over yet.

In 2012, in the case Caronia v. FDA, the federal Court of Appeals for the Second Circuit held that "truthful and non-misleading" statements made to promote a prescription drug off-label were protected by the First Amendment right to free speech.
